I believe its only illegal if you pick the phone up. Just remember when it rings to look around for the police, if they dont catch ya then anything is legal.

Its the actual holding of the phone that gets you into trouble the way i see it, if you have your earpiece in and just push 1 button to accept a call then thats okay, but dialling a number yourself or holding the phone is a no-no.
I know different bobbies will have slightly different interpretations but thats mine, i know one guy got a ticket for holding his phone in his hand as he talked to it on speakerfone which i think was fair enough, that'd be enough for me to get my pen out. But talking with both hands on the wheel cant be getting you into trouble in my eyes.

You'll be allright chap, now that you can't use your phone it will give you more time to reach across for that packet of fags that slid across the passenger seat and fell down near the door, then remove one cigarette, grab your lighter, light it, then open the window, all with one hand

lol I forgot about this topic, I have recently got 3 points on my license for using a Mobile. ONLY thing is, I wasn't using a mobile, I was done for having a tyre under the legal limit and after sending my license to have the points put on I noticed the offence code was a CU80 and not a CU30 as it should have been.

What I use now is a cheap (about £1 from tescos) vent holder. Just whack the mobile in there at the start of a trip, and if it rings I just need to push 1 button (by feel) and the phone andwers in speakerphone mode. Everyone's happy - except the person on the other end of the line who sometimes hears me say "sorry, I needed to focus then... can you repeat everything you said the last 3 minutes?"
Also you need to remember to close the vent otherwise it apparently sounds like you're standing next to a tornado ;)
