So I spoke to the dealer today - completely unhelpful and wouldnt discuss it.
He kept stating that on the invoice given to me that "The odometer reading may be incorrect, as used vehicles mileages cannot be guaranteed".
He believes that this then covers him from this apparent clocking even though he didnt do it.
Unfortunately http://www.adviceguide.org.uk/england/c ... eading.htm states that even though he didnt do it he is liable for investigation and/or procescution via trading standards.
Also the SOGA 1979 does clearly state: -
Goods supplied by traders must be 'as described', 'fit for their purpose' and of 'satisfactory quality'. Basically, they should be safe, durable and free from faults or defects. If a trader breaches these laws then you could have a right to a refund, repair or replacement.
So I am sending a letter, ill let you guys know whats gone on!

send a letter to the person you bought the car off,
iwouid write to them and say you have intentions of taking them to county court,
if there was no mileage disclaimer sticker placed on the clocks when you bought the car you may stand a chance,
if you write to the seller with a intention to sue letter send it via recorded delivery,

Hoping that the dealer see's sense.
The letter was polite but basically said you failed to to adequate checks on the vehciles mileage ( He only used a auction HPI check not the DVLA MOT history checker) thus he is liable as he advertised the car at 100K Miles not the 140K it should of been.
He also said that the car's value hasnt dropped an inch even though 40k miles have appeared on the odometer!
