Fixed Penalty Notice help wanted

Post by trem1 »

I wonder if any of you have any knowledge of fixed penalty notices, My daughter was pictured stopped in a bus-stop dropping a passenger off and has received a fpn for £35.
Now there are 2 photos , the first shows the car stationary and the second taken 10 seconds later shows a passenger getting out of the n/s door.
Is this allowed or is there a waiting time allowed in bus-stops, Can you stop in a bus-stop at all or are they now no-go area's.
If you need to drop someone off is it better to stop before or after the bus stop or is it safer to pull-in
Can she appeal against this or is she just stuck having to pay????

all advice wanted please
Neil

Just pay it, it's £35, aint going to break the bank.
Your not allowed in a bus stop regardless as far as I'm aware. The only difference is if it's one of those ones thats just painted on the road.

I'm affraid Sam is right, if a little lacking in diplomacy. If it is a marked bus stop, ie painted on the road, then it is a no stopping area. I know we've all done it, but it is illegal. One of those things i'm affraid. The other way one can get caught doing this now is the front mounted cameras on buses. Most have them now.
Bit like speeding, we all do it, and hope we don't get caught.

So, from what you say, no points? It could be worse.

Sorry Trem, but you best off just paying it while its at £35 stage the longer you leave them the more they bump the price up,

ive just got aparking fine for £25 after 14 days it goes up to £95 and after that £115 and then it goes to court.

Apeal ? no good that they wont listen and you will find they will just tell you to put it in writing ,
then that goes into File 13,

iknow its not fare them slapping you with £35 for a few secounds but thats how they work,
atleast Dickturpin had the decency to wear a mask Huh,

This seems very mean.
Can anyone find any references demonstrating that this is an offence?

The best I can find is Highway code (waiting and parking) item 243: "do not stop or park... at or near a bus or tram stop or taxi rank". However, this item also includes "on a bend" which is clearly not enforced with quite so much zeal.

Also, note item 240: "You MUST NOT stop or park on... a road marked with double white lines, except to pick up or set down passengers". So exceptions apply if you are picking up or setting down passengers.

I would really like to know exactly which rule they are applying, and which legislation allows them to issue a FPN.

Unfortunately, in practice, it is probably better just to cough up

I'm with everyone else on the bus stop thing I'm afraid, but at least it is only £35.

However, on the subject of parking fines, it would depend on who the fine was from. Proper traffic wardens & local authorities & I would pay up, but if it's one of these a**ehole private companies that charges you for being 10mins too long in a Lidl or Tesco car park, then stuff them. I received one for parking 2hrs 20min in a free for 2hrs car park last year & did some looking up when I received the parking notice & found that it's a bit of a scam of sorts as all they can take you to court for is loss of revenue & the revenue on a free car park is 0. I ignored it, received further letters from a collection agency acting on their behalf (yet from the exact same address) & eventually they just stopped sending them.

The only way ican see /work out on how to get out of paying a fine for being parked in a bus stop
is to have your Hazard lights on,

They carnt fine you if your car as Broken down
iknow it hasnt but you know what imean :supafrisk:

Another one wouid be stopping to alow the passenger to get out she /he was throwing up,

Health reason or vehicle defect or breakdown will be the only thing you throw at them to drop the fine,
county court wouid bin the fine for one of the above

When my neighbour tried the broken down thing, they asked for proof. Eg you called the AA or similar. He said he fixed it himself. They said don't believe you, and upped the fine by £30. I guess the best way is not to park where we shouldn't. In these days of cameras on every lamp post, it gets easier to get caught. Unless you've got a disabled badge, then you can abandon it where ever you like.
Ever been caught on a London red route? Automatic towing to an impound yard. £100s later, you get your car back.

That's a bit harsh trem, I didn't know it carried a fixed penalty especially when I think of the number of times I've dropped people off in a bus stop!
You could argue that it's far safer to drop off a passenger in a bay than stopping on the road side & obstructing traffic! @rseholes :frown:

35 quid is cheap - my "Parking in a bus zone" fine was $280 AU - do the math :cheesy:
