Legal question, ideas?

Hey all,
just looking for ideas on this,

Heres the story. last tuesday my bro died,
ive not seen him for a few years,nor my mother but shes seen him daily.so shes got access to his apartment,
police have been looking for her as shes gone missing..where to or why we dont know. :?
but the apartment belongs to some sort of housing association.so obviously they will want it back,
we are just waiting on some sort of temporay burrial /cremation pass now from the coroner.

thing is my bro's car,. wouid we have the rights to move it, ?
No keys etc..
where it is parked now..theres a big chance the scrap lads will have it away.

Firstly sorry to hear about your Bro and I hope your Mother turns up asap, what a mess.

I'm not sure why the scrappers would take the car, if they'd have wanted it they would have taken it before now? and they're not going to know the owner is no longer with us. If you do get the keys you have every right to drive it as long as you're insured because you are doing so for the benefit of your bro's estate an not for criminal reasons. It would make sense to store it somewhere until you get hold of the V5 and are able to change ownership via the DVLA so it can be sold/transferred.

Sorry to hear that Lozz, hope your Mum turns up safe.

I've got no legal skillz but what Welly says sounds sensible. If the apartment belongs to the HA, don't they have a set of keys? Surely it'd be in their interest to let you in to start sorting the place out (including finding the car keys) if they want to take possession back? Is there a will or a probate process going on?

I don't think Housing associations keep spare keys but you could try ringing them and ask if they could gain entry for you. (after all thats what would happen eventually).
Quite a predicament.

Thanks all,
Yeah that sounds like the sensible option, 'iwill leave it where it is for now,
ive tried talking to my father about it..but he just changes the subject, he dont want it idont think,hes almost blind so he wouid never be able to drive it.
i dont want it going to scrap,but it might happen,

still waiting on the paperwork from the coroner..so we carnt arange anything yet,

Can't really add any practical advice to what's been said already, but I'm really sorry to hear about your loss and I hope your mother turns up safe and sound.

Lozz, my wife sorts out stuff like this in her job working for a bank.
She says if there is no will the next of kin (your dad or mum if there are no descendants...no wife or kids) has the right to do what he wants with the car and any estate your brother had.

He made no will or anything like that. iguess he was too young to think that far forward,

'Im not sure what to do next,ive tried talking to my dad & sister,but im getting no where with them,
i keep telling them to inform the council and everything but the subject soon changes, its as tho they dont want anything to do with it,
but my bro's debts will still be clocking up no doubt, & ive heard most debts end up sometimes get passed on to next of kin,.

iwill find a solicitor me thinks,

Well, still no paper work from the 'c'.
so ijust went to the undertaker's all paper work done there & they will sort the rest,
Funeral next thursday,

everything else wont be sorted until more or less next year,(inquest) :(

'so called mother is still missing, not that icare realy,(words fail me,) :frown:
