Leaving work today the barrier came down on my car.
Specifically, I approached it, it started going up, I started going through, then instead of continuing up like it usually does it came down.

So I'm pretty pissed off. (Though probably not as much as plod after the hail stones.) The tops of the doors and the roof is scraped, and there are dents in the roof. :cry:

The security guard showed me the video, and the sequence of events as described above is clear. He said I should have waited for it to go up. I said I didn't do anything I haven't been doing for the last 6 years. I have to call the park manager tomorrow.

Any ideas where this is likely to go, or what I can expect, or how I should deal with them?

Its More than Likely Mechanical error:

But Security Guards are there to protect the Interests of the company
as Well as the Property, So More than Likely he wouid of Been Breifed Before about What to Say when These Errors Accur of which
they will Twist things to Make it look like the Error of the driver and not Fault of theres,

It May Result in you having to go through small claims court or Claiming on your insurance,

Speak with The Manager and see what he Says, if he/they dont Admit liabilty
go see a solicitor


the Barriers shouid have a sensor fitted,
ive looked on the internet and its all over there about Sensors have been fitted to barriers.

Stand your ground Mate and tell them its Mechanical Error no fault of yours,

Iwouidnt Take anynotice of what that Guard said to you,

thought perhaps you wouid of found that useful but Maybe not,

A sensor on the other side of the barrier detects when the car has passed and the barrier is lowered.

ta for all that; pretty comprehensive.

The next question is what to actually do with the car. It looks a right mess, but its in good mechanical order: there's no point repairing it but there's also no point scrapping it.

if you have some spare time Richard,complainn in any institution,dont give a f*ck,its your property damaged by somebody else,english people has more rights:)

Well one wouldn't wish to cause a fuss :wink:

Seriously though; the park management company didn't deign to call me today, so I'm looking for a solicitor now.

I've had to park on the street for the last 8 months or so and the scratches and dents I've collected is just sickening :( There is actually no point having anything decent.

Put something in writing and send it to them By recorded delivery,

if then no reply from them Seek legal advice,
Sadly it wouid be Rather Expensive to take them to small claims court :(

You can do Most of the paperwork your self.
thats all a solicitor wouid do is write to them 1st, and get anice fee for the privalage :frown:

Sorry to hear bout ur car mate but don't let them get away with it fight ur case there not ment to come down wen there's a car there if at the end u don't get anythink out of them hook a chain round it and rip the hole thing out and see how they like that
