Funnily enough the sickie prospect was mentioned in a meeting last week & the Warehouse Manager stated that orders have come from above to come down very hard on anyone that doesn't turn up on Boxing Day because it'll be unfair on those that do.
However, I'm currently working on a contractual issue with this as my contract states that Christmas Day is excluded & the following page states that we get a premium of 100% for working Boxing Day OR the bank holiday in lieu of & directly underneath says that we can convert one of our holiday days to the paid equivalent.
I read this to mean: we don't have to work Boxing Day if we work the bank holiday in lieu of Boxing Day & the fact that there is no mention of the bank holiday in lieu of Christmas Day means that it is classified as Christmas Day contractually & we shouldn't work that either. I would also take this to mean that for working the bank holiday in lieu of Boxing Day we should get the 100% premium AND a day off in lieu.
Anybody legally minded that can help me with that one? Was thinking I might scan my contract & send to ACAS & ask if they could ascertain from that what days I should be working over Christmas.
