[quote="scotty73Had my hour in court this morning and am now awaiting a decision through royal mail  the decision will be made today and posted out so this thread should be revived again by the end of the week.

Why were you not told the decision there and then? I had my decision and a hard copy within a couple of minutes of me leaving the room so that they could have a discussion, it's normal practise round here.

it seems they had a lot to discuss because I've been awarded 18 points in 3 different discriptors. :cheesy:

ARRRGGGHHHH i was hoping to never drag this thread up again  it's been 3 weeks now since i heard the outcome I've had nothing from the dwp of jcp in writing, no back pay which would be really handy right now  I'm still on the assesment rate and starting to feel like my pisser is being pulled.

I know Lanelli dwp got their copy on the 27th November and forwarded that to Merthyr (where the decision was made) but that's all i can find out over the phone... I mean ffs how long can it take for some suit to type in my bank details and click PAY? :(

It will take a while longer than 3 wks before you hear anything scotty,
My mate got his back pay but it took around 10weeks, (he didnt get no letter, either )

Best thing to do is ring them once a week, (hound them)

I think you've been a bit unlucky mate. As I said earlier in this thread, I received a written decision only minutes after my court hearing and back pay, nearly £2500, was paid into my bank account 3 days later. Part of the problem is the system, my claim was being dealt with on the south coast but the admin centre is up north and the two don't seem able to talk to each other. Also as I'm sure you have found out is it is no longer possible to talk to the officer dealing with your claim, you have to go through a call centre which passes on a message, and if you do get a return call it is never the same person as everyone is out of the office or on leave etc.
Keep smiling it will sort itself out although you shouldn't have to be subjected to all the stress it puts you through.

Did you get a breakdown of your lump sum? i read somewhere about compensation, not sure if there's any truth in that?... 10 months of interest would be good too.

No breakdown but it was what I was expecting. Something that you may or may not be aware of, and I am not familiar with your case obviously, is that if you were on a higher benefit rate prior to ESA then you must be put back onto the higher rate if it is more money. I'll explain with my case. I was on long term Incapacity Benefit and then DWP decided to put me through the ATOS treatment. Atos found me fit for work, 6pts, and so I was placed on Job seekers. I immediately appealed and so was placed on assessment ESA, £67 per week I was on £180 a week leaving quite a shortfall. After I won my appeal, 27 points from 4 descriptors and placed in Support Group as I am classed severly disabled, I was put back onto £180 a week and backpay was calculated from the amount of shortfall X no. of weeks at lower rate. I am on more than standard ESA that new claimants get and will remain on £180 until ESA catches up with me through the annual increases, my benefit is transitionaly protected.
Confusing or what? And they wanted to make the system easier?

Why would they make it easier? Just think of all those poor pen pushers they'd have to sack if they did

Correct Steve.

Ah now so I'm not going mad i remember talking to the woman who first phoned to say I'm due the medical and she said to me that if i win I'll be put back on the rate i was on £108 per week until esa catches up but I've not found proof to back this up and the general idea on the dwp forum was I'd go on the £99 per week that is now paid for esa.

When i found out i won i roughly calculated it as a £37 a week shortfall for 43 weeks = £1591 because esa Assessment rate is now £71 per week but was told by the call center it would be £28 per week = £1204 it's all guess work but i know which one I prefer.

Like you said earlier though the call center are not the people dealing with my case so he was probably guessing.
