According to a previous thread on new MOT testing rules - 1st of Jan 2012 any car that was fitted with a car post 93 will have to have a cat - thats why I am fitting one, otherwise I wouldnt bother.

The 2.2 has upstream & downstream temperature sensors, plus two pipes which lead to the differential pressure sensor that monitors FAP backpressure, (all of these are required simply for FAP monitoring & regen). Once you de-fap your car you don't need any of them, (or the additive tank, ecu and so on), but I think the prudent way to go is to leave no external signs that anything has changed, then I don't believe there will be any issues come MOT time. I suspect anything you do after the cat/fap chamber won't matter to Mr MOT, (unless it's too loud).
If they can insist on a cat, maybe they can insist on a FAP too.........
