Re: General working personal opinion
Just a quick bit of encouragement for those going to ESA appeals, Atos gave me 6 points, I appealed, court asked for last 2 years worth of medical records and gave me 27 points. All the time I was on appeal I was on reduced benefit but once I won my case the DWP paid up two and a half grand back payments no problem. If you think you have a genuine case stick with it.

That is encouragement mate, i also had 6 points, did you have anyone represent you? i see another 15 points in my claim at least but through sheer embarrasment and thinking it was just part of my day to day life i didn't think to mention my toilet problems on the original forms.D9406 wrote:Just a quick bit of encouragement for those going to ESA appeals, Atos gave me 6 points, I appealed, court asked for last 2 years worth of medical records and gave me 27 points. Re: General working personal opinion
I really feel for everybody struggling with these heath issues and getting money from the state that you appear to be entitled to.
My brother had a heck of a job getting his rightful money (they stopped his disability payments saying he was fit for work when clearly he wasn't....he was a coal miner and suffered the lung problems associated with that....he got compensation as it happens from the government due to his lung problems and mining).
In my own case being self employed I got £54 per week when I was recovering from my first heart attack (14 weeks altogether), I had the taxman hounding me for extra tax, 4 grand, which I had to find in 4 weeks.
I don't work full time now that I had another heart attack and 2 lots of stent surgery, but I'm still going

Re: General working personal opinion
Talking coal miners Jasper my dads having a hell of a time of it too he's got the chest problems, had some comp for dust in the past and is now suffering badly with diabeties he's popping well over 20 tablets a day through these problems but is waiting to get called by the dwp... ironic as it is though because he's on a pit pension (albeit a small one) him and my mam get hardly any money anyway... It's a good job their house is bought and paid for.jasper5 wrote:I really feel for everybody struggling with these heath issues and getting money from the state that you appear to be entitled to.

I honestly think if the dwp call on him my mam will give up she looks well knackered to the point she only heard half of my problems tonight i been keeping quiet.

Re: General working personal opinion
Thats unfair that jasper5,
54 quid aweek what did they expect you to buy with that, baked beans
theyve paid out millions this year too people that suffer with aledged headaches, and those that are genuily ill that have worked all there life are slamed with benefit cuts, ialways thought the national insurance they took out of peoples wages coverd all this,
obviously not,

Re: General working personal opinion
Hi Scotty 73, No representation because legal aid wouldn't pay for it, only advice. So I did it myself, I ripped apart the Atos report as it was full of inaccuracies, contradictions and things I had not said. The Atos doctor had retired 15 years and when he examined me he noted muscle wastage and scarring to my leg but I never removed my jeans so he must have lied. The tribunal questioned my version of how ill I am as it was nowhere near what Atos said and so asked for my last 2 years medical records from my gp and hospital. When I went back to court the second time they agreed with everthing I had said and gave me 27 points innstead of 6, placed me in support group and classed me severly disabled whereas DWP had told me to get back to work with no restrictions.scotty73 wrote:That is encouragement mate, i also had 6 points, did you have anyone represent you? i see another 15 points in my claim at least but through sheer embarrasment and thinking it was just part of my day to day life i didn't think to mention my toilet problems on the original forms.D9406 wrote:Just a quick bit of encouragement for those going to ESA appeals, Atos gave me 6 points, I appealed, court asked for last 2 years worth of medical records and gave me 27 points. I have nervous dystrophy, incurable and progressive, inoperable ruptured muscles, degenerative disc disorder, arthritus, drug dependency due to prescription drugs and under hospital care. When DWP read all of this in my hospital notes they said it was irrelevant. Ho hum.
But like I said, if you are genuinely ill ignore DWP and ask for an Oral Tribunal Hearing. Good luck mate and dont let them get to you. I took great delight in proving them wrong.

Re: General working personal opinion
Company I used to work for used to work with Atos when they were Atos Origin, thought they were IT consultants?
They met me in Italy, basically as translators / go betweens, and the fella cracked up because I took pasta and potatoes with hot dog bites, instead of regular potatoes.

Re: General working personal opinion
Support group is for those who are deemed unable to do any form of work because of their disabilities, not even part time. No sick notes have to be sent in and I do not have to go to job centre for back to work interviews with their "experts" who "are going to remove the barriers to work" for me. Basically they have written me off. I also get a little extra in benefits each week.

Re: General working personal opinion
They do not have the right to access your facebook account.
Some employers have tried this and have been denied on the grounds that they could gain information on a persons race, orientation etc. from it.
Deny them this, or rightly claim to not have one.
